AI-Assisted Content

By participating in the KittySpout Affiliate Program, you grant KittySpout a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, adapt, and repurpose content you create in connection with the Affiliate Program for advertising and promotional purposes.

• Social media

• Advertising campaigns

This license applies unless you notify us otherwise in writing.

Traffic Source Disclosure

Affiliates must accurately disclose the sources used to generate traffic or sales, including where applicable:

• Social media accounts

• Third-party channels

• Referral channels

• Other promotional sources

Prohibited Affiliate Activities

Affiliates may not use:

• Coupon aggregation websites

• Deal aggregation websites

• Cashback websites

• Unauthorized discount-code distribution

• Undisclosed traffic sources

• Misleading traffic sources

Paid Advertising Is Prohibited

Affiliates may not use paid advertising to promote KittySpout unless KittySpout provides express written authorization.

This includes, without limitation:

• Google Ads

• Microsoft Ads

• Meta Ads

• Facebook Ads

• Instagram Ads

• TikTok Ads

• Display advertising

• Shopping advertising

• Sponsored search placements

• Other paid advertising platforms

Affiliates may not bid on, target, purchase, or otherwise use:

• “KittySpout”

• KittySpout trademarks

• KittySpout domain names

• KittySpout product names

• Brand variations

• Brand misspellings

• Confusingly similar search terms

in paid advertising or sponsored placements.

Affiliates may not:

• Direct paid advertising traffic directly to kitty-spout.com

• Compete with KittySpout's branded paid-search campaigns

• Impersonate KittySpout in advertising

• Create advertising that may reasonably be mistaken for official KittySpout advertising

Content Ownership

Affiliates must use:

• Original content; or

• Content they have obtained legitimate permission or licensing to use.

Affiliates may not reproduce, copy, distribute, or republish content created by another KittySpout affiliate without permission.

Traffic Verification

Affiliates must be able to provide reasonable evidence showing how sales or leads were generated.

We may request information such as:

• Links

• Screenshots

• Website pages

• Social media accounts

• Traffic analytics

• Keyword lists

• Search terms

• Campaign information

• Traffic logs

• Promotional content

• Other reasonable evidence

KittySpout reserves the right to verify traffic sources and promotional methods.

If an affiliate:

• Violates these Affiliate Terms;

• Uses prohibited paid advertising;

• Engages in unauthorized brand bidding;

• Provides false or misleading traffic information;

• Refuses to provide reasonable verification; or

• Generates sales from unclear, unverifiable, fraudulent, or prohibited sources,

KittySpout may, where permitted by applicable law and the relevant Affiliate Program terms:

• Withhold commissions;

• Deny commission for affected transactions;

• Reverse previously credited commissions where permitted;

• Disqualify sales or leads;

• Suspend the affiliate account; or

• Terminate participation in the program.

Transactions generated through prohibited activity are not eligible for affiliate commission.

Affiliate Disclosure Requirements

Affiliates must clearly disclose their commercial relationship with KittySpout in accordance with applicable advertising, endorsement, and consumer-protection laws.

Where applicable, appropriate disclosures may include terms such as:

• Paid partnership

Affiliates are responsible for complying with FTC disclosure requirements and applicable local regulations.

Fraud and Manipulation

Affiliates may not generate commissions through:

• Manipulated orders

• Incentivized traffic where prohibited

• Deceptive promotional practices

• Any activity intended to improperly manipulate affiliate commissions

Affiliates must respond within a reasonable period to legitimate compliance, verification, or payment-related requests.

Failure to cooperate may result in payment delays, commission withholding, suspension, or termination where appropriate.

Participation in the KittySpout Affiliate Program constitutes acceptance of these Terms and any applicable Affiliate Program Policies.

Continued participation following updates constitutes acceptance of the updated Affiliate Program Terms.

These Terms of Service and any separate agreements through which we provide Services will be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer protections that apply in your jurisdiction.

3-Year Limited Warranty Terms and Conditions

1. Warranty Coverage

This 3-Year Limited Warranty (“Warranty”) is provided by NovaK Ventures LLC, operating as KittySpout, for eligible fountains purchased directly from:

kitty-spout.com

This Warranty covers qualifying defects in materials and workmanship under normal household use, subject to the terms, limitations, and exclusions described below.

1.1 Standalone Warranty

Coverage

Each separately purchased 3-Year Limited Warranty applies to one (1) eligible fountain.

The covered fountain must be identifiable through valid proof of purchase, such as:

• Order number

• Receipt

• Other accepted purchase documentation

Multiple Fountains

If multiple fountains are purchased individually, a separate standalone Warranty must be purchased for each fountain in order for each unit to be covered.

Covered Components

Subject to the exclusions below, eligible coverage may include repair or replacement of:

• Defective water pumps

• Fountain components damaged during transit

• Control modules for wireless fountains

• Other qualifying components specified at the time the Warranty is purchased

1.2 Bundle Warranty

Where a qualifying bundle includes multiple fountains and an applicable 3-Year Limited Warranty is purchased for that bundle, a single Warranty may cover all fountains included in the qualifying bundle.

Coverage will be determined using the applicable bundle order information and proof of purchase.

Subject to applicable exclusions, eligible components may include:

• Water pumps

• Fountain components damaged during transit

• Wireless fountain control modules

• Other qualifying components included with the bundle

2. Warranty Period

The Warranty begins on the original purchase date shown on valid proof of purchase and continues for three (3) years.

A repair or replacement performed under the Warranty does not restart or extend the original Warranty period.

Any repaired or replacement product or component remains covered only for the remainder of the original 3-year Warranty period.

3. Warranty Exclusions

This Warranty does not cover:

• Damage caused by misuse, abuse, or neglect

• Failure to follow care or maintenance instructions

• Normal wear and tear

• Seals and gaskets affected by normal wear

• Cosmetic damage such as scratches, fading, or discoloration

• Damage caused by improper installation

• Unauthorized modifications

• Unauthorized repairs

• Damage caused by low water levels

• Freezing

• Lightning

• Environmental damage

• Acts of nature

• Damage caused by unauthorized accessories or components

• Commercial use unless expressly approved

• Incidental or consequential damages to the extent permitted by law

4. Warranty Claims Process

To submit an eligible Warranty claim:

Submit your claim during the applicable 3-year Warranty period by contacting:

Step 2 – Provide Proof of Purchase

You must provide reasonable proof of purchase, such as:

• Order number

• Receipt

• Other accepted transaction information

For standalone Warranties, identify the fountain associated with the Warranty.

For bundle Warranties, provide the qualifying bundle order details.

Step 3 – Describe the Issue

Provide a reasonably detailed description of the issue.

We may request:

• Photos

• Videos

• Troubleshooting information

• Other evidence reasonably necessary to evaluate the claim

Step 4 – Inspection

We may require you to return the affected fountain or component for inspection.

Where applicable and stated by us, we may provide a prepaid return label for eligible returns within the United States.

Step 5 – Resolution

If a Warranty claim is approved, KittySpout may, at its discretion:

• Repair the defective component;

• Replace the defective component;

• Replace the fountain with a comparable model if the original model is unavailable; or

• If repair or replacement is not reasonably feasible, issue an appropriate refund relating to the Warranty purchase price, prorated according to the remaining Warranty period.

5. Shipping Costs

For approved claims involving products or components damaged during transit, we will cover reasonable shipping costs for eligible replacement components.

For other Warranty claims, customers may be responsible for shipping the defective fountain or component to us unless otherwise specified.

For eligible United States claims, we will generally cover shipping of approved repaired or replacement items back to the customer.

International customers may be responsible for additional shipping costs.

6. Warranty Limitations

Limited Warranty

This is a limited Warranty.

Except where expressly stated in this Warranty or where required by applicable law, we disclaim other warranties to the maximum extent permitted by law, including implied warranties of:

Non-Transferability

The Warranty is non-transferable and applies only to the original purchaser.

Geographic Scope

Unless otherwise expressly stated, this Warranty applies to eligible fountains purchased and used within the United States.

Customers outside the United States should contact us to determine whether coverage is available in their location.

7. Consumer Rights and Applicable Law

This Warranty is intended to comply with applicable consumer warranty requirements, including the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.) where applicable.

This Warranty does not limit rights that cannot legally be waived under applicable state or federal law.

Some jurisdictions may provide additional statutory or implied warranty rights.
